I was evicted from my apt. in August 2006 after losing my job. It is showing on my credit report. I called the apt. complex to obtain information and was told the previous owners of the complex have sold the property and there are new owners of the property. The Asst. Manager of the apt. complex told me that someone else was requesting information on an eviction around this same timeframe and that the previous owners have refused to give any information to the new owners. What recourse do I have to find out if this is a debt that I am still responsible for or that the debt has been dismissed?

I'm not sure what state you're in, but my answer(s) applies to California.

Evictions (like most civil matters) are a matter of public record.

If you were evicted pursuant to a writ of possession, you very likely have a money judgment against you. Even if no monetary award was granted in the proceedings for the writ of possession, all the landlord/agent/attorney has to do is file a simple declaration as to the amount of rent owed after the three day notice was served until the date the writ of possession was satisfied. That amount will be awarded along with the amount of rent owed as stated in the three day notice. The monetary judgment will bear interest at 10% per annum until satisfied and can be renewed indefinitely.

The monetary obligation (assuming there is a money judgment) you owe to the previous owner of the apartment building may have been transferred to the new owner, sold or assigned to a third party, or remain with the original owner. This can be ascertained by sending a validation letter (search FDCPA) to whatever collection agency currently has the account.

Good luck.
