I was evicted in 2006, garnished successfully in 2008-2009 for the eviction. Since they got away with that part and over $1400.00, the same property and attorney's office is wanting to garnish me for damages, concessions, etc. Can they sue me again for more? The original detainer says all damages are included. And can they sue me 3 yrs later for a property that I only occupied for 28 days (mind no time to even cause damages) and I was garnished before for?? Isn't there a time limit for stuff like this?? PLEASE HELP.

State of Arizona. The detainer says: 4. Rent per month is 773.15 and other related charges, including late charges, previous balance, return of concession, and damages (if any) is due and unpaid since 7/1/06 for total of 888.15, plus continuing damages from 8/1/06. NOW, they are wanting to sue again for: compensatory damages 1181.49. Isn's that suing me for the same damages?

Contact the attorneys office to request more information regarding the specifics of the demand for more money. Explain that you've already gone through a lawsuit and garnishment on this rental.

If it comes to an actual court hearing, have all your evidence regarding the judgement and garnishment from the previous lawsuit. You will be presenting this as evidence to the court that this debt has already been paid.
