eviction notice

I receiceved a eviction notice stating I owed Nov rent as of the 14th I paid it on the 14th. Yes it was late but i paid all late fees. Can they still evict me and if so what could i do to not get evicted. They have already filed suit and i have 5 days to give 5 reasons I should not be forced to move, to the county clerk and their lawyer.

Any and all advice would very much be appreciated

Did the rent and the notice (which is more likely to be a "Pay or Quit" notice as opposed to an actual eviction from the court) "pass" each other in the mail?

In other words, have you discussed this matter with the landlord/management?

We got a notice from management on the 6th to pay or get out by the 12th
My roommate talked to them and told them we would have it to them by the 14th which we did. today there was a eviction notice on our door

You have received a summons for eviction (not an actual eviction notice). You have five days to answer the court in regards to this matter. If you do not answer within this time period, the landlord can file for a Default judgement and the eviction will occur.

If you do answer (and I'd suggest you do) then a hearing will be set up in front of a judge where both sides (you and the landlord) can argue your case. Filing not only buys you some time but it does allow you to present the information in court that you have paid your rent for this month.

The judge will then decide if the eviction should take place; however, they are less likely to do this if the tenant can show they have paid both the rent and any late fees.
