We live In Los Angeles County. We rented a town home on 8/18/2008. Signed a 6 month least with the owner. We had encounted many, many problems with the unit, including no working stove, washer/dryer, no mail key, etc. On top of that the complex was undergoing major construction. They boarded up one of our windows that allows access to a porch, we werent able to park in our garage for weeks, and were not provided guest passes to mark in assigned spaces. We decided to conatct our Landlord in November by mail stating we were unhappy and listing all the problems we had endured. We asked if we could have a reduction in rent for the previous month as well as going forward. He said yes, but pay hat you owe first and then we will re-negoiate. We found out out on October 30 that he filed a Notice Of Default on 8/5/2008. He had not paid the the mortgage, and was not paying the mortgage. We get a pay or quit notice from a property managment company last week requesting November and Decmebers rent. We were never told a property managment comapny would be taking over. They only us mailed the notice, it was hand delivered or posted on the front door. Tonight a gentleman served us with an eveiction notice, from this so called property managment company. Are we responible for paying this property managmnet company?? Is their way of serving us legal in California? If the property managment company has "taken over" the mortgage payments with out any notice to us, are we liable for the back rent?
