I cosigned for my son's apartment. He had a 12 month lease. Friends of his threw bottles from his balcony-he was told to move out or they would start legal proceedings. We are being told we must pay 2 months beyond the date he moves out, plus additional money for each month he was in the apartment-since they had given him a discount.
It seems that since they want him to leave that we should not have to pay all of this additional money. I do not live in California.
 
Technically your son has not been evicted; only a court can actually file an eviction order on someone. His landlord has, however, started the first step toward eviction by posting a notice of vacate to your son. If he does not comply their next step may be to file for the actual eviction.

This does not negate him from his financial responsibilities toward his rent contract. He would be reponsible for the rent until a new tenant is found. As a general rule, a court allows a landlord about 2 months to accomplish this (although it can take longer depending on the time of year and rental market). This is why they are telling him about this two month business.

If one could walk away from a legal contract that easily tenants would be doing all sorts of things to end a lease.

Thank you Gail-I was surprised that they said he was going to have to pay an additional $400 per month for each month he was there. They said they gave him a discount for it being a year lease and because he was a student and now they want those funds also
