My question is this. I moved in to my apt in the middle of october 09. Have a signed paper stating i paid the security deposit but never have signed a lease. Im late on the rent this month and he wants to take me to the magistrate and evict me. What legal grounds do i have if any without the lease and what rights does he have to evict me without a lease?
 
Your landlord can begin the eviction process due to failure to pay rent whether one has a written lease or not.

It's pretty difficult to come up with a valid reason as to why one should not be evicted when one fails to pay their rent.
