Eviction?

I have a question concerning a rather unique roommate situation. I own my condo, and have rented a bedroom because I needed the income. I am disabled, and unable to work outside my home.

My tenant has been here for just over a year. We don't have a written rental agreement, and he is on a month-to-month basis. At the present time, he is $1,134.28 behind in his rent and utilities.

He has no security deposit. He was supposed to have one, but it was used to pay rent for a month when he was between jobs.

He is extremely messy, and does not ever clean any of the common areas of the house. For the last several months or so, he has been confrontational any time I have asked him about doing his share of anything, or when I ask for rent. I can't finish a sentence without him screaming over top of me, and he is verbally abusive. I strongly suspect he is taking drugs, and have smelled smoke (marijuana) coming from his room - and this is a non-smoking house, since I have severe allergies.

I need to evict him, but he says he has at least 60 days that he can stay without paying rent if he feels like it. One Florida statute I read says that I can give him 7 days notice to vacate due to noncompliance.

PLEASE help... I am already sick, and this is increasing my stress level to an unhealthy degree. I need to know exactly what options I have, and what I need to do.

give him his notice to leave. Since you are on a month to month there is no 60 day rule. Don't listen to him. Tell him you want him out by the end of the month.

You might want to call legal aid if you qualify and see if you can get some legal advice, but don't listen to his threats.

You can then sue him for any balance he owes you.

give him written notice that he needs to find another place to live.

you also might want to call your city and see if they offer any type of landlord/tenant mediation.

Without any written lease you might be able to give him the boot asap.
