My brother in law makes minimum wage and can't afford an attorney. He lives in michigan. His wife moved out while he was at work and got a restraining order with no police reports or any past evidence of abuse. My question is if he gets to their school play before her and has a friend text her that he is there, does he have to leave when she gets there or is she obligated to stay away because she knowingly knew where he was. Any other advice on the subject would be appreciated. Since they have split up he hasn't done one thing to warrant a restraining order. Here are some other random facts:

1) She was seeing her current boyfriend for 3 years while they were married.
2) She stopped making house payments for 2 years until they got foreclosed on then told him. We think she saved up that money which is why she can afford an attorney and he can't.
3) She purposely does things to try and get him to violate the order. For example her boyfriend is going with her to the kids christmas concert but because of the order he can't.

She is an evil woman.

She's an evil woman your brother in law chose. So let's leave out the name-calling, okay?

1, 2 & 3 don't matter.

As a general rule, a restraining order doesn't bar the restrained party from attending a public event (and the school play would probably count). Mom would absolutely not have to leave.

Why would #3 even matter? Who cares about who attends an event with Mom?

This of course assumes that the restraining order doesn't include the kids.

But really, this shouldn't even be an issue. The parents should be able to handle being 100 or 500 yards from each without trouble, surely?

In this case (school play), he shouldn't have to leave when she gets there & she shouldn't have to stay away.
