ex boyfriend motioned for temporary custody

My ex boyfriend has motioned for temporary custody. He tried to take my son away from me in march but since he had previously lost rights to another child I won emergency temporary custody. He recently was allowed by the courts to see his other child twice a week but the visitations are supervised because he has a history of drug abuse. He also has not had a job in over a year. I however, have no criminal or drug or alcohol abuse history and I have had the same job for over a year. My work hours are strange so he keeps our son on the days I work, but he drops him off at day care even tho he doesnt work. I have another child whom I have had sole custody of since he was born. Our court date is tomorrow, what are the chances of the judge granting him guardianship and/or custody?

Is this just some dude YOU hooked up with, or is this dude YOUR baby's daddy?
Not that it matters, I'm just curious.

Your problem is that YOU allow this DRUG ADDICT to keep the child so YOU can avoid paying for child care.
If this DRUG ADDICT is good enough to babysit, he's probably going to get some form of legal visitation or even joint custody.

You can't have it both ways.
If you trust a DRUG ADDICT to babysit, the court will TRUST that DRUG ADDICT with some kind of parental rights.
That is, IF the DRUG ADDICT is the baby's daddy.
If, on the other hand, he's just a your former "boy toy", he has no standing.
I doubt that he'll get anything.

But, allowing a known DRUG ADDICT (who has lost custody of another child) to baby sit isn't going to make YOU look good in the eyes of the court.

I've seen women and men lose custody of their children for such poor decisions.
 
he is my childs father and I didnt allow him to watch my child because I didnt want to pay for childcare, I done it because my work shifts are 12 1/2 hours long and I work overnight and on saturday and sunday..daycares around here are not open at those times. I do not trust him but he lives with his parents, who i do trust and they are the ones who take care of my son while hes there.

You need not explain anything to me.
I'm not the judge in your case.

You can characterize anyway you wish.
The fact is, YOU allowed the baby to stay with a DRUG ADDICT.
That jeopardizes YOUR custodial rights.

You might want to speak with a lawyer.
If you take the tale you told here into court, you're making bigger problems for yourself.
If the DRUG ADDICT is good enough to babysit your child for 12 hours a day, the court will say that is foolish and take your child.
Or, the court will say, the DRIG ADDICT is good enough to babysit, so he can share custody with you.
After all, you chose the DRUG ADDICT to make a baby with.
Besides, the DRUG ADDICT is legally the baby's father.
As the legal father, the DRUG ADDICT has rights equal to yours, unless he loses them.
