Ex-Boyfriend Sueing Me

i was sued by my ex-boyfriend for a money he had put down for a truck i purchased in my name with a civil agreement stating he'd pay for it. the civil agreement also states that i can end the agreement if the other party is incapable of paying, or i feel that he is incapable of paying. it states that all repair expenses are to be covered, and he was to carry insurance on the vehicle - which i also had to do because he couldn't ever produce a copy of his insurance...so he paid me per month for that as well. the truck was stolen in april of last year, and recovered, and placed in the shop to be fixed under the insurance. there was a 500 dollar deductible due. he was arrested for something and tried to make arrangements to pay it, but couldn't 'commit' to anything. after 30 days of the shop holding the vehicle, i had to pick it up or they would have charged me storage. at that time he had stopped making the payments, and now has sued me for the money he put in. what are my rights on this?

we appeared in court about a month ago. we both stated our cases. he was awarded a judgement. i filed for a trial de novo, and was granted one. he placed a bank levy on me, without ever trying to collect, we have an ongoing criminal case as well - he broke into my house and is currently being charged for trespassing - and has no way of reaching me (I have changed my phone number due to harassment and past ex parte orders) although he still finds a way to harass me through other means, he's never mentioned the civil or criminal charges or judgments. i filed for a writ of exemption (i file head of household, have one minor child, and receive child support monthly). we had another court date set. i showed, he didn't. the new judge ruled in my favor. of course then my ex files for an extension, which leaves the money on garnishment by the bank apparently, and no new court date has been issued. is he simply wasting time because he doesn't have a case?
 
I personally would sell the truck and give him the proceeds to pay the judgment.

The problem with that is he put a bank levy on me, including the loan on the truck which is through the bank. So even if I wanted to sell it, I can't. Plus, why in the world should o have to sell something that he defaulted on just to pay him money I shouldn't have to owe him anyway?

The court has already determined what your rights are, pending the outcome of the trial de novo.

Because the court said you DO have to owe him the money.

Good luck in your trial de novo. Why do you think the outcome will be different?
