A salesperson recently quit. One of my customers tells me that he has dropped by their office soliciting for another company in the same industry. I have a confidentiality agreement that covers company customers among other items.

I believe that his current employer does not have an existing relationship with my customer.

I've already contacted the ex-ee to let him know that I think he is in breach and that if it continues, I will call an attorney.

Should I put his current employer on notice that he signed a confidentiality agreement?

He also called a woman that we are trying to hire to try to talk her out of working for us... he is a gem. She also called to let me know about this.
Is this an actionable item?

Thanks

CA laws on non-compete agreements are different from those of most states. In any case, no one here can comment on the enforceability of an agreement we have not read. Consult local counsel.

If there are any CA attorneys who regularly post here, I am not aware of them.
