My husband and I were officially divorced June 27th of this year. During mediation we decided that the house was to be put up for sale and the proceeds (if any) will be put towards credit card debt. I gave him checks July 13th & 27th for my share of the July mortgage. On August 10th I told him that I forgot to bring the check and he said he was not worried about it. On August 15th he told me that he has decided to not pay the mortgage anymore because he can't afford it. He moved into an apartment August 1st and is now paying that instead. We are behind 2 months, July & August, mortgage and the house will forclose. I do not want the house to forclose but I cannot afford the mortgage alone. Doesn't he have an obligation to pay, not only for the fact that it's a loan, but also because we both agreed to selling the house in mediation? Do I have any recourse?

Thank you.

Why dont you move in and get a roommate? There is probably nothing forcing him to live in the home or pay the mortgage. Unless the decree specifically says he is to pay half, you might nor be able to do much but to borrow money to pay it until it sells. Have you listed it yet?
