My ex and I have been separated for over a year now(our court date is actually Feb 14). Nowhere in our separation agreement is there anything that states I have to refinance the house to get his name off the mortgage. It only says that I am responsible for the bills and making the payments on the mortgage. He wanted me to refinance because the mortgage was showing up on his credit. I have a pretty good rate and I didn't want to lose it so I told him I wasn't going to refinance right now. I said I would do an assumption through my mortgage company so that way I get to keep my interest rate. He refused to pay the fees, and I don't think it is my responsibility to pay for him since it really doesn't affect me either way whether he is on the mortgage or not. So he went ahead with the loan officer he was dealing with and applied for a refinance loan from the bank in my name. I got the packet via fed ex the other day. He had given them all my information:my ss#, how much money I make at my work for the year, the amount of debt I have,etc. Now, I had no idea he was doing this, and I surely had not given my permission for him to do it. My question is whether or not it is legal for him to do that. I thought that no one, but myself, was legally able to give out my personal information. Am I right or is he allowed to do that? Thank You
