My name is Anthony B, and in 2008, I was Issued a judgement in court in the amount of $780 (one mo. rent) after I moved out of a house where I was on a month-to-month lease, because the landlord refused to repair the air-conditioning unit! This was in July, during the summer months in Texas, and it became unbearable to reside there.
I'd advised the landlord that the AC wasn't working, but instead of trying to repair it, he begun accusing me of "not knowing how to operate it..."
I reminded him that I had been at that residence for 2-3 years prior, and never had a problem "operating" the AC, and asked him why would that be a problem all of a sudden?
He became very "undiplomatic", and the discussion turned into a very "heated" argument!

At that time, I felt our landlord/tenant relationship had reached a level where we could no longer discuss the matter without arguing, so I moved.
The landlord never actually, to my knowledge, even investigated to see if the AC unit had malfunctioned or what the problem was with it, while this was all going on.

Two of three months later, I get a subpoena to appear in court on this issue. But when I get to see the judge, he basically asked me if I paid the landlord the final months' rent, I said "no, but..."
I don't know what happened after that! I went so fast, that judge seemed uninterested in the facts I wanted to raise about "why" I hadn't paid.
The gavel slammed, and now I owe this guy nearly 800 dollars on a judgement, and he kept my deposit (another 780 dollars)!
Is this the finality of it? Is there some way I could have this Re-heard by the court? I don't wanna give this guy another penny, but this judgement is damaging to my credit report, and must be dealt with

The hearing in 2008 was not about why you didn't pay.

It was because you didn't pay.

When you withhold rent, you must have very god reasons, backed up by statute.

In your case, a malfunctioning air conditioner is nt one of the statutory reasons to withhold rent in Texas.

You had no case in 2008!

You have less of a case today!

The only way to dispose of this matter s to pay the judgment in full.

You betcha it is final.

And, even when you pay, the stain and stigma to your credit will not be cleansed.

No, sir, that takes years
!

The only solution is pay, or file bankruptcy!

Bankruptcy won't entirely cleanse this stain, but it'll remove most of the dirt!

Bankruptcy itself will not be easy these days!!!
