Ex said i can never see my son again!!!!!!!

I have barely gotten to see my son since he was born because two days after he was born i got deployed to iraq and when i got back in sept 2010 my ex and i broke up because she was cheating on me and wanted to be with a new guy. Since then i barely gotten to see my son maybe twice. And now she keeps saying i can come see him, which means i have to drive two hours to have her watch me hang out with my son because she will not let me be around him without her there, but she also will say i can see him then change her mind. Like a few weekends ago for example, she said i could have him but then one of my friends, who is a girl, commented on my facebook page and she called me and said i couldn't see him that weekend anymore. Then a few nights ago that same friend commented on a picture and because she called me babe my ex went off and sent me all these text messages saying i will never see my son again and how i am not allowed to be involed in his life and the only dad that he will know of is her fiance, and telling me that i can thank my new girlfriend that i will never get to see him again. I am scheduled to take a class called, "For the kids sake" so i can get a custody hearing.

Questions

1. Can she really never let me see him again, i mean is that legally allowed?

2. What are my chances of getting some kind of custody of him and if so what kind?

3. All the text messages that she sent to my phone to prove that she hasn't let me see him and I won't be able to ever again because some girl made a comment on my facbook, can I use those in court?

1. Unless you have a court order entitling you to visitation, she is - unfortunately - not obliged to let you see your son.

2. Joint legal custody is entirely possible, with ample visitation.

3. Likely not - but even if you did, I'm not sure what they'd accomplish.

Once you are established as the legal father (if that hasn't been done already), and you have a visitation order in place, she CANNOT deny you time with your son.

So, file in court asap to get the ball moving.

You don't necessarily need an attorney, but one might be best.

You need a lawyer.
No class is going to help you.
She has ALL the trump cards, because you weren't married when lil Junior was born.
You need to hire a lawyer.
Ask the lawyer to help you establish paternity.
Ask the lawyer to formalize a court ordered custody plan and arrange for formalized child support.
If you're still in the military, contact JAG for minimal legal guidance.
Your kid is entitled to an ID card and certain military benefits & health care.

And, for your own sake (at least until you get custody established) take down all social networking sites!!!!

The only reason I am taking the class is because the court said i had to before i could file the paperwork to get a court date.
