our tenant separated fr her husband and is now in an ugly child custody battle. Because of domestic violence historythe judge ordered the husband to refrain fr entering the current home or yard. He is to stay in his vehicle when the children are picked up. due to financial difficulties ( no child support) she has not been able to hire an atty to finalize custody/divorce issues. Both have equal rights although the husband uses to children to "borrow" things fr the home and never to be returned. Recently, the husband enlisted his mom to walk up the property and take 1 one of the children ( the 12 yr old that was left thought grandma just wanted to say hi to the baby) and was told he was not returning the baby because he has not broken any law. As the landlord, can we send a certified letter to the husband stating that he or anyone related to him either by blood or friendship are not allowed in the property..without needing a court order fr a judge? We do not want our rental property to be in the gray area of a custody battle. we are tired of seeing the cops get called.

Yes I believe you can issue a criminal trespass warrant. Call your police and inquire with them.
