My husband of 5 years left me and our four children ( 2 from a previous marriage...the youngest 2 are his) for his pregnant mistress jan 08 and did not pay child support til court ordered in oct 08. Along with child support collected thru the child supp collection unit he was ordered to pay half the cost of daycare each week. The child support is coming in regularly even though hes unemployed ( he brings home $405 a week not working and I bring hom $350 working 40 hrs a week) he has refused to pay any of the daycare..not one dollar and now he is roughly $1600 behind in payments and I have finally taken him to court petitioning for a violation. He is now being very difficult disputing the validity of the daycare receipts saying that my daycare provider and I are covorting with each other to falsify the receipts so I can " saok him for everything". Claims he is going to be granted court appointed lawyer so he can legally dispute the receipts and get out of paying the back money...is this a possibility. The receipts are in fact valid..I pay $185 every week and the cobwebs in my pocket do NOT go unoticed.
Another thing is that he is refusing to file his taxes in order to prevent me from getting $1250 in back child support...is this legal?
I have sole legal and physical custody of the both boys and there is set visitation 3 weekends out of the month but when I offer for him to see them longer on school vacations or days off he refuses and says he will only take them if I give back the child support for that week. The kids are suffering and I am as well. because of his negligence and lack of responsability I could lose our home. Please any advice is appreciated.

You cannot force him to file taxes and even if he did no guarantee he will get a refund. Has he asked about child care credit on his taxes? For that though your child care provider needs to provide a Tax id # (SS#). He can certainly try to dispute the claims for child care but he may not get anywhere. Are both kids in daycare? I doubt he will get a court appointed attorney that is usually not given in family court. He is probably just bluffing.

yes both children are in daycare. Hes doing whatever he can to get out of paying what is court ordered. The order was put into affect in 11/08 and was never appealed by him and now that he owes $1600 and Im finally taking him to court over it all of a sudden hes being threatening and accusitory and outright difficult. Hes making claims that hes going to be appointed a lawyer who will assist him in getting out of paying the back support and whatnot and I wanted to know if he can actually do this. I find this whole situation ridiculous.
