My ex-boyfriend and I signed a 6 month lease for a condo. We moved in May 1st. 12 days later, he decided that he didn't want to be with me anymore, and he made me move out. He had somebody new living there before I could even get my possessions. A little over a month ago, he called to let me know that his roommate moved out, and that he couldn't afford the condo any longer. He asked if I wanted to have the place and I said no. He then stated that he was going to either borrow money from his family to pay off the lease, or he was going to take out a loan to pay for the remainder of the lease. He said that he was uninterested in taking my money, and that he got himself into this situation, therefore he would get himself out. 2 weeks ago, he took out a $3000 loan, and paid the real estate agent for the remainder of the lease. Now, my ex is trying to get me to pay him for the loan that he took out. My name is NOT listed on the loan anywhere. He is a cop, so I'm sure that he is planning to take legal action. I have constantly been in contact with the real estate agent, to make sure the bills were being paid.. even when I wasn't living there. My name was still on the lease, so I made sure that everything was taken care of. Am I legally responsible for the loan?

How did your ex-boyfriend make you move out? You should prove or obtain proof of his evicting you (emails, letters, voice mail) as well as who moved in if you can and I'll explain why. You are not liable for the loan - that's his problem. You are on the hook for the lease and the landlord can sue you if not paid.

He can try to sue you for your half of the rent. Your defense is that (a) he owes you 50% of the money you put up for the first month's rent since he forcibly evicted you, and (b) in addition to the eviction, he replaced you with another tenant and thus you should have no liability to pay him a dime. Having the name of the roomate would help you prove the eviction as he moved someone else in lightning quick. Perhaps getting something in writing (notarized at the very least) attesting to the eviction from the real estate agent would be of assistance (although she may need to be called into court as a witness if it goes that far.) My defense would be that my slimy ex tried to fraudulently induce me to co-sign on a lease with no intention of my living there - he dumped me immediately afterwards and forced me out. Whatever expenses he had to pay are entirely his own and I have no responsibility and could not reap my own enjoyments from the lease as intended solely due to his actions. Good luck.
