A friend of mine's ex-wife of a few months has recently found out that my friend, her ex-husband, has started publically dating someone. She wants to legally limit his time with their son & daughter (3 & 7) because of this. The ex-husband and now girlfriend had become friends prior to the seperation (about a year) and the ex-wife believes the girlfriend had something to do with it. He told me he doesn't care that his ex believes what she does, he just wants to be able to have his children legally and also persure this new relationship. there is no legal custody in place right now, only had word of mouth agreement that he could see them when he was able to.

You should suggest to your friend that he HIRE a lawyer to assist him with setting up a legally enforceable court order that lays out support, custody, and visitation for him.

Agree, he definitely needs something legally binding in writing re custody/visitation etc. arrangements. (court order that has to be followed)
