Extended warranty voided

I bought a used Acura MDX from a Toyota dealership 2 years ago. The dealership offered a warranty, which I originally purchased for $1500 to cover the big items for 36K/3 years. The next day I took the car to an Acura dealership to get checked out and make sure nothing looked wrong from their techs perspective. During that visit, I specifically sat down with a service advisor and asked them if this car had a warranty (factory or extended). I told him I bought the car from a Toyota dealership the previous day. He looked up on his computer and said yes it did to 100K. From this discussion I went back to original dealership and reversed the purchase of the Toyota warranty.

Over the past 2 years I had also taken it to another Acura dealership nearby and asked them if I had a warranty and they assured me that I did.

Then one week ago the dealership diagnoses a bad transmission, needs to be totally replaced. I brought the car in suspecting just that in fact and could tell over the past few thousand miles that the transmission started feeling odd. The dealership called the warranty people (another division of Acura) and NOW Acura is stating that since the warranty passed through another dealership (non-Acura dealership) that no extended warranty exists and I need to pay for the cost of the transmission. The dealership is graciously offering to cover 'half' the cost -- but still they want to bill me just under $3000 to do the work.

So now not only am I out an extended warranty, but if anything else happens I am not covered either. Do I have any recourse here?

Did you ask the Acura's dealership how long the warranty was good for? You bought the car used and have had it for two years so the factory warranty might have expired in the meantime. Did you get anything in writing from the people who said yes you did have a warranty still in effect? There is big difference between an extended warranty and the the original warranty. Extended usually is purchased through the dealership you buy the car from. The warranty Acura mentioned to you about two years ago sounds like the factory warranty. SO maybe you misunderstood what you were being told. Always get the facts in writing. You should have requested a copy of the warranty at the time Acura told you there was still one in effect. Also, some original warranties have exceptions when a car is resold and sometimes certain maintenance must be performed for the warranty to remain in effect.

Yes, actually I did ask how long it was good for -- there was a factory warranty good until 50K and then an extended warranty to 100K. There was no misunderstanding on my part -- I was very clear with them and they were likely very clear with me. I didn't get anything in writing though -- they did print up the warranty sheet (but not the verbage, just the coverage). Too bad I didn't have the conversation recorded.....but I didn't have that much forethought.
 
The milage warranty also has years attached like 3 years or 50k miles (whichever comes first). The extended warranty should have years too. You may be able to go to Acura's website and see if they have anything on-line about warranties and call their corporate office. If you call have that warranty sheet you mentioned and the mileage from the car ready. There may be "verbage" in the warranty that excludes cars that have been resold and since you didn't get the full warranty with explanation you weren't made aware of any exclusions. Explain all of this to the corporate headquarters and include names of the people who told you there was a warranty in place, address of dealership, and dates that you spoke to the individuals. Also tell corporate that you had purchased the extended warranty from the dealership (Toyota) and canceled it based on wht Acura employees told you and that you want to file a complaint. Maybe someone there (corporate) will help you.
