My partner is being held in Texarkana,Arkansas on a failure to appear charge. 5/6 years ago he was in a relationship with a lady, after 3 months she decided they were getting married,he said no and left the relationship, this she did not like and after a lot of harrassing calls and visits, she finally figured out he wasnt going to go back,so she went to the police and pressed charges of theft against him for things she had given him as gifts,it went to court,he was bailed out,he missed his court date as he was out of the state working and made the dumb choice not to go and get it sorted out.The lady first said he had stolen things to the value of $3,800,his family have given statements to investigators explaining how the lady had bragged about giving him those gifts and how he hadn't stolen anything and were willing and ready to go to court to testify,he did how ever pawn 2 nail guns, which she has the reciept for but other than that he took only what was his and what she had given him.
Since my partner and i have been in a relationship,we have talked everything over and had decided to save up some money and pay for a lawyer and get this problem sorted out... unfortunately he was picked up down here in Alabama, early April this year and transported back to Texarkana,he has been in jail on the failure to appear charge ever since. He went to court on the 1 July but now the lady has upped the list she says he stole, now it is upto nearly $10,000 as she now says he stole some family heirlooms,so the trial was adjourned until the 9th October.... since then my partners boss has contacted the DA who is dealing with the case(as we had tried and tried to get hold of the public defender dealing with it but never got a reply nor any help whats so ever from her),the DA said that the lady was a woman scorned and was out for revenge, that he knew the list that she had given him was serverly padded BUT because of the failure to appear she had my partner over a barrel and that my partner was looking at some serious jail time 5 maybe 10 years in jail just for the failure to appear,he suggested that we offer the lady some money as payment, which we did, we offered her $2,500,she turned this down flat, she says she wants $4,000,my partner to get 10 years probation and a restraining order against him to stay away from her. The DA has said that if we pay the money he will drop the failure to appear charges and have the probation transferred down here to Alabama. My partner has been told that if he went to court to faces the charges,he may only get 30 to 90 days for the failure to appear and maybe just probation for the charges as she has no proof of anything she says he stole other than the nail guns.
My partners boss has the money to pay the $4,000 that the lady wants BUT we have been told that it might be better to go to court and get it sorted out there,as 10 years probation is way to much but the DA says the lady wont budge on that.
Does anyone know what the penalty for failure to appear on a felony charge in Arkansas is? Also does anyone have any advise as to which way would be best for my partner to take this.
Thank you for any advise anyone may give.

Does anyone know what the penalty for failure to appear on a felony charge in Arkansas is?The FTA penalty will depend entirely on your partner's prior criminal history. Sentences are longer for those who have a criminal record however I find that 5 to 10 years is a bit excessive for a missed court date. Find yourself a good local attorney to help your partner in the negotiations with the DA. Good Luck!

Thank you for your reply, unfortunately i am stuck in Alabama and unable to get upto Arkansas,he has public defender who again unfortunately doesnt seem to even be trying to help him in any way, i know they are really busy and swamped with cases but i have tried and tried to contact her but am always told "sorry she is out of the office,i will tell her you called and get her to call you back" i am still waiting.
This is his 1st criminal offense and as we neither of us have the amounts that defense attorneys ask for a felony case,we will just have to deal with the DA direct, which isnt a good idea but we have no choice , the public defender has shown no interest in helping with that.
Again thank you for you reply.
