Hi all, statutory law needs duty, breach of duty, causation, and damage. I am in a situation where the body has been cremated, and based on external examination of the body the cause is Cardiovascular Disease. With the description of the event, it was most likely ICH (Stroke), so the survival rate is like 8% had the defendant called on-time.

My question is can you charge someone criminal omission since the defendant effectively deprived the descendent any chance of survival?

You can't charge them involuntary manslaughter since it's not a direct cause...

YOU can't charge anyone with a crime.

The prosecutor or district attorney makes that decision.

You can discuss your concerns with the police.
Maybe the police will decide to investigate.

You can talk to a lawyer and see if you can bring a civil lawsuit.
