I am a little concerned i was arrested over the weekend on a saturday at 3pm. I was in a parking lot outside my friends car. The car was off and we were not in it. An undercover approached me and grabbed my arm, I ran away and he and another undercover tackled me and beat me for about 1 minute. Made my head bleed. I had no drugs or weapons on me. The Police Searched me a few times and found nothing, but they insisted that i had drugs on me which i didnt. They then searched the parking lot which i was in for about 20 minutes. Undercovers found in the parking lot away from the car and away from me what they say is 2 Vicodin in a bag in the parking lot. Which they showed to me. Again they were not on me but in the parking lot. They say I threw the bag while running away. The reason they approached me was because they said they saw me put drugs in my pocket which is untrue. The reason for me runnning when the undercover grabbed me when i was next to the car was because i thought i was being mugged. I am being charged with...
1.)CPCS 7th 2.)Resisting Arrest 3.)Tampering with evidence 4.)Harassment 2nd 5.)OGA
I have 2 prior DUI's in New York. One DUI Pending... Will I be able to get the new charges dropped since they did not find the Narcotics on me?? also they did not read me my Miranda Rights... Nor was a Sheild shown to me when the undercover grabbed my arm.All he said was "POLICE" and he grabbed me and then i ran. I am pleeding NOT GUILTY and will take it to trial if i have to. Does anyone have any advise...
