My adult daughter was just served with a District Court Misdemeanor Citation taken out against her by a man who has been harassing her. He came to the door of her and her fiance's home, telling her that his Uncle wanted her evicted! Her partner owns the mobile home they live in, and has rented the property for twenty years. My daughter has lived there, with him, for twelve years!

In his charge he stated that he was frightened of her! He said she used threatening language, and he wasn't well. So he went to the Sheriff's office and made this complaint. (The man has moved himself, his family, his adult son, and a brother with children on to the property of his elderly uncle and aunt. I can't even think of a word for this type of person...Freeloader, Conman, I don't know!)

He lied to the deputy! She did not use threatening language. She did not raise her hand to him. She used a couple of four-letter words! And they were both yelling at each other. My daughter is 5'2 in. And this man is 5'8. As I said, he has been harassing her for several months now. He has been trying everything he can think of to evict her. Not her partner, but just her!
There was never any type of rental or lease agreement between any of the parties.

There is so much more to this situation...but to begin, how does she fight this misdemeanor charge?

Go to court, tell her side of the story, and tell him in court to prove his side. he brought the complaint, so he has the burden of proof.
