Hello on December 18, 2012 an individual that I was supervising stated that I pushed her while we where at work in the companies chart room. According the supervisee, injuries to her left wrist occurred due to this alleged push by me. However, the supevisee did not report this alleged attack to the company, until the next morning upon her return to work(12/19/12).Due to this supervisee false report I was suspended without pay for three weeks, while the agency conducted a full investigation, however I was not suspended until December 21,2013, three days after the supervisee made her false allegeration against me. Then, On December 24,2013, the supervisee went to percinent near the agency's work site and pressed assault charges againist me. I was contacted by telephone on 12/26/2013 stating that I needed to come into the precinent, because a warrant for my arrest will be issued if I did not come into the pricinent on my own merit. Which I did obey, I went to the precinent and was fingerprinted and release due to not having any prior convictions. However, I am a social worker by trade and my fingerprints were sent to my agency to inform them of my pending case and that I was arrested. Once the investigation was completed at my job, I was informed that the investigation was unconclusive because their were no witnesses ,however my job demoted me and took $9,000 in salary from my pay stating that they use other factors related to my work performance as their reason for demoting me. However, I have never received any thing in writing stating that my work was unsatifactory.

I am currently waiting to go to court on March 26,2013 as per the desk ticket, I received from the preicenet. However, since my demotioning I was hired for a job but once my fingerprints should that I had a pending assault case, I was not off the position.

My question how I could a proceed with a civil suit against the supervisee, who made the false claim, which has cost me to be demoted, not able to obtain employment in my field of work due to pending assault charges( most jobs in my field of work requests fingerprints before staff is hired). How can I sue the supervisee for her false claim, once I am found not gulity.

A finding of "not guilty" doesn't mean you are actually innocent of the charges, but merely that the State hasn't met their burden of proof.

That aside, you'd have to show that the employee willfully and maliciously made a false report - this is NOT easy to do.

I do suggest you have a chat with a local attorney though, just to see if you have any feasible recourse.
