my friend who holds a student visa was falsely accused of domestic violence. He dated a woman for one month and when they broke up she wanted to charge him for something he did not believe he owed to her, an amount of $200. She blackmailed him and said she would only give him his belongings if he paid the $200. So he said he was going to pay it and he gave her an envelope with a letter in it instead. after she saw there was no money in it, she drove with the help of two of her friends to where he and his friend were walking home and she got out of the car and started pulling his shirt, yelling and trying to hit him. He kept pulling her hands out of his face and kept walking; at one point she was pushed back a little and her own hands touched her face. He was able to cross street breaking away from her while she tried to pull his shirt. The next day she decides to go to the police and accuse him of something she did and her friend who was in the car half a block away states she also saw him holding her hand and hitting her on her face, despite the fact the police did not see any bruises. His friend who was next to him claims the harassment came from her and he did not touch her in a violent manner. She herself states in her police report that she did it first. However, the law states that once one is accused you have to go to jail for one day and then defend oneself. Do you know what happens with his student visa, or the possibility to get a visa in the future? If he is falsely accused and they decide to resolve the case before going to court, is it a problem? Does he have to go all the way proving his innocence so it will not affect his immigration situation or can it be resolved outside of court? He has evidence from before that she wanted revenge against him and she set him up in a way because she got very mad and her friends were helping her.
In any case, that day she was the harasser and not him, whatever he did was all in self defense, and his friend who was very close to him saw everything and cannot believe they went to that level to get revenge for $200 not paid. Is there any way he can sue her for falsely accusing him?
