I have a friend that works evenings and usually gets home around 7am. Two days ago, shortly after getting home she had two uniformed officers show up accusing her of hitting and killing a neighbor's dog and leaving the scene. It was a large husky dog and this particular morning it had started snowing around 2am. Well she is a very careful driver especially in the snow and was driving at a very slow speed. The officers were very aggressive and intimidating stating that they know for fact that it was her that killed the dog because they spotted her tire tracks in the snow and followed them to her house. They inspected her vehicle and found no damage, no blood and/or fur. The only evidence they had was the tracks. They demanded her information and told her they will call her with the findings from the veterinarian they had brought the dog to. The vet said that the dog died of trauma. The officers said that she did hit the dog and that it was an accident and they will file an incident report. They also returned to the owner of the dog and gave him all her information and told him she killed his dog! Well now, the owner of the dog is blocking access to the alley that she uses to get to her home along with all her neighbors. The neighbors called to complain and the police stated that he was within his rights as long as he didn't block them. So now my friend has to contend with the owner of the dog, whom is known to be very unstable, and her neighbors. All of whom believe she killed the dog due to the police assuming she had to because of the tire tracks. They didn't witness the dog being hit nor are there any witnesses. They couldn't even tell when the dog had been hit and killed so it could have happened at any time during the night. The dog could have been hit at midnight and she may have passed the carcass after it started to snow! I just can't believe that the police can accuse, try, and convict someone not allowing them to defend themselves in court? As it stands right now she's not only traumatized by the fact that she was accused of something she did not do but now she fears that the owner will retaliate against her or even sue her! Does she have any way of clearing her name on this? Can she bring her case to the City Manager to see if the police can do a better investigation so that she can rest easy that her neighbor won't bring harm to her? Am I wrong in asking these questions? I told her not to sign anything or even speak to the officers any further. It just doesn't seem right what they did to her.
