State of jurisdiction is California.
My husband and I were living with my sister in her home. She was diagnosed with cancer in January and died in July. We are still living here in her house. My sister made a Family Trust and hand wrote some things on a separate paper (of the content we do not know) to be included with the trust. My nephew was made administrator of the trust, with my niece as secondary and I as third in case anything happened to any of the others. My sister said that my husband and I were to keep possession of the house and live here as long as we wanted or until we died, she also stated that there was to be no monies borrowed against the house. That we could do anything we wanted in decorating the house and the nephew and also my niece were to pay for the upkeep and any structural repairs necessary. I am 66 yrs. and my husband is 73 yrs., he is very ill and we just don't understand our rights in this situation. I don't even know if anything about my husband and I was written in the trust or on the paper. We are really worried about all of this.
My nephew has refused to give us a copy of the trust or the letter my sister wrote. He said that the trust had to be filed in court and was now in probate and that he didn't have to give us anything. With all the stuff going on (the above mentioned kids causing problems with all family members) I feel that we are getting the run around and possibly the shaft, and that we should have a copy of these items to have a chance to protect our interests, as the kids have stated on several occasions that they really would love to have the house as it is free and clear of any debt against it. Mom is gone now and they can do what they want. They are also refusing to do some structural work that is much needed to be done. Can they force us out of the house? What can we do to protect our rights without any making enemies? Do we really have any rights? My sister told several people, besides family members that we were to stay in the house and pay only the insurance and taxes, which we have done.
Sorry this is so long. We desperately need help. Please advise of the steps we need to take not to be put out on the street. Thank you in advance.

You should be able to see the document that was filed. Contact the courthouse and request a copy.

Without seeing that, it's impossible to say what your rights are. Even with it, whether you have the right to live in the house and whether the estate will pay for upkeep etc. may require a court to sort out. You should contact a lawyer.
