My father willed all his assets to my stepmother, when he died his assets was transferred to her. Her name was not on any of his properties prior to his death. My father had 10 children and she had 3 children. They did not have children together, they both had their own separate assets. My father and stepmother agreed that if he died first she would divide his assets with his children. She recently died, and her 2 surviving children are getting all the assets.

It doesn't matter what they agreed on/talked about - it needs to be in writing. If she had a will, the will is followed. If she had no will, then the intestate succession laws of the state of Tn. apply. (link below)
