Father remarried, but says i am in his will he dies, new wife stands to get it all.

My father (79) married a woman 15 years younger than him. They own a house jointly. My father has 3 children with my mother/ his wife has 2 children from her former marriage.All adult children. My father tells me that I am in his will. I don't see how that means anything since his wife is very controlling and will probably get the house when he dies. Which means the house is hers and any other money automatically becomes hers. He insists that his 3 children will get an inheritance. Can you explain how, and how can we find out? By law does the court notify you if you are named in a will? I would like to know what my rights are. Asking her is out of the question.
 
Ask your dad for a copy of the his will. If it isn't in the will (or he has no will), his estate goes to his wife.

Let's hope dad is around for a long time. Heck, she (even you) could predecease him!

Could I please also note that at 79, a 15 year age difference is absolutely NOTHING at all?

(Heck, my husband is 13 years my senior and I'm still - marginally - in my 30s. We're deliriously happy and gosh darned, actually did it for love! I realize that's a scarce concept these days, but still...)

Well I did ask Dad to see his will. He said he has one and that I am in it and that's all I need to know. I guess my real concern is that he could very well predecease his wife and we will never know when she dies. I am sure his will states that we get a share of the proceeds of the house since that is all they really have. I don't think the courts will force her to sell or to pay us as long as she is still living in the house. So my original question still stands, if he dies first, what are my rights?
 
You don't know what the will reads, because dad won't let you see it.

You could ask if a copy exists at your (or his) local courthouse.

Otherwise, you have no rights in this matter. Dad has spoken, you should respect that.

You don't know who will die first. You could expire before any of the people you mentioned. God will decide in what order He chooses to call His people to Glory.

His spouse is his legal next if kin, if he were to predecease her without a will. I doubt that dad would disposess
his wife.

You'll just have to await the outcome of this saga. I hope your dad lives 30, 40, or even 50 years more. God bless him.
