Fathers Cs Nightmare in Colorado

The old court ordered CS to be paid in the amount of $160 a month. Visitation to be 50/50. This arrangement went as ordered for only two months. The mother moved out of state without any modification to the Order. the child then lived with Me (The Father) full time for three months .The Mother then Violated Order by removing child from state without modification of the court order.and has since been convicted of custody violation. My son was MISSING for 5 months.and once he finally was recovered he lived with me.

the CS collection People suspended my Driver License for not paying Child Support. Total Amount Owed $2000 ($162x12 months) I dispute this amount Because the Order was only Fallowed for 2 months..


The new court order states no CS with me Being the custodial Parent. (never addressed in the first order)
My Question is how can i get this resolved? and if i file For CS would the judge order it even if I Owe Back CS?

CSE follows the court order. If the order wasn't modified during your son's absence or the time he lived with you, then you are responsible for paying it. You may be able to petition for elimination or reduction of the arrearage, but you will probably have to do that in court.

Why didn't you ask for CS in this current order? Check your order to see if you can even go back for a modification this soon.
