feel bias in employment

Hi I Had an interview with bristol Myers Squibb on Tuesday September seven.It was a new kind of interview because the interview was at 1:15 -5:00 pm. Another reason it was unique because they are interviewing all the candidate in one setting. So I had met the competition. There was another guy and girl. The guy and me came were there before 1:15 and were on time.We both were different ethnic background While the girl who was white came like 1:40. She said she got lost to interviewer. Another thing I noticed was that the girl was not dressed professionally. She was dressed in jeans and shirt. I interviewed 5 different interviewers and all five said I was qualified for position. A day later I found out I didn't get the position, and the girl did. Do I have a case against bias in hiring since she was late, dressed unprofessional, and was still hired for position?I believe race was another issue since she was white while me and the other candidate were different ethnic background.

Discrimination isn't about what one believes.
It is about what one can prove.
You have no proof that BMS did anything untoward or illegal.
Barring that proof, they chose the person they preferred to hire.
That is and remains an employer prerogative.

 
Do you know how many "qualified" applicants there are for any given job these days? Could be as many as 100 or more.

Besides, being early or late, dressed professionally or unprofessionally, neither is a protected characteristic/class.
 
yeah but only three were interviewed for position. I would not have said anything if she came on time and was dressed for interview. I would say yeah she was more qualified.
 
It doesn't make any difference. How one is dressed is not a protected class under Title VII of the Civil Rights Act or any state anti-discrimination laws. We all have "biases" and "discriminate" every day, when we decide whether to have a burger or a hot dog, or to wear the black flats or the gray heels.

You have your opinion. The employer has theirs. And, guess what? In this case, the employer wins.
