Yesterday, my husband and I received a phone call from a lawyers office stating that we were being charged with check fraud across state lines. This stemmed back to a credit card account in my mothers name only and a joint checking account with her and my name was on the checking account only. In order for them not to prosecute her, her and I set up payments for her credit card (while in collection) to come out of our joint checking account. Her debit card was stolen and I froze the banking account because it was in the minus by $200.00. The credit card company called and I told them the situation and told them the payments at that point could not be taken from this account until the account was unfrozen. My mother was supposed to keep in contact with the credit card company and I fixed the bank account issues and got it back into good status again. Well, my mother never kept in contact with the credit card company (they called her 48 times and mailed numerous letters and affidavits) and yet again bounced checks. Within the time of this happening I met my husband and moved in with him. This was October 2006 and I did not marry him until July 2007. He and I went to his bank and tried to put my name on his bank account and that's when we found out the joint account again had bad debt and I could not have a bank account until this was paid. I paid it and then made sure that the account was closed and cleared. Well, my mother not taking care of the credit card company and I was not aware of this, they were still sending the payments (15 payments to be exact)to this closed account and they were going back unpaid. Yesterday, a lawyers office called and told my husband and I that if we didn't pay $10,500 by 2pm we were going to jail for check fraud across state lines. I know my name was on the bank account, but this debt they tried to collect was her credit card debt. How can I or my husband be held accountable for her credit card debit? Yes, I know I did allow the first few payments to go through, but it was not responsibility to keep in contact with the credit card company and the payments. When this was happening I wasn't even using the account or authorizing any more of the payments. Needless to say, my husband maxed out his credit cards to pay and now have to practically sell everything we own to pay it all off. What can we do?
