Feeling Bullied at my own home

This is kinda long but might be worth my while. I am only 19 and in January of 2007 My boyfriend and I decide we need to move out of my mom's house and got an apartment for 419.00 a month (thats including the 20 bucks for animals). At the time our landlord was a middle-aged woman who was very understanding and realized that we were new at this and was willing to help us by letting us pay our pet deposit over the course of our lease. Well after moving in and being there a few months the b/f lost his job and we got behind on bills and we unable to pay on our pet deposit. However we paid every months rent and if we were a day late we paid the fifty bucks. Well 6 months into our lease out of no where we got a new landlord. We were not informed in any way that this change would be occurring and after a month of the new guy he puts a newsletter on our door making sure he points out some clauses in the lease that many are failing to follow. Then a week later(on a friday) I get a notice on my door saying that my pet deposit must be paid in full by monday or he is taking me to court as well as a new pet agreement attached to the letter. The next moring I went to his office to tell him that the old landlord and I had made an arrangement to pay the pet deposit over time and that I was just now getting caught up on my other bills I had not forgotten I owed it I planned on paying it I am young and learning with money as I go. I also highlighted everything in the new pet agreement that was different from the old one and refused to sign the new one. He told me that all the stuff I highlighted was common sense and is no different from the other. Bull.....I signed an old copy. Then paid him a small amount on the pet deposit and told him I would pay a little more each month with my rent. He was an ass about it but let me do it. Now yesterday he puts a memo on my door stating that I have tens days to replace my blinds from where my cat gets in and out of the window and there is a square missing in them. Tells me they refer to clause 11 in my lease which states "The resident agrees to maintain and be responsible for any and all appliances, fixtures, storm doors, glass, and screens." Then he states that my mini blinds are a fixture. ( they are?) I have no problem replacing my mini blinds. I knew that i would have to before I moved out if I wanted a deposit back. However, I have 4-5 months left in my lease and why would I want to replace my mini blinds now when the cat is going to do the same thing. I can disipline the cat when I am at home but when I leave she's a cat she wants to look outside. I like my privacy and don't want neighbors to look into my apartment so I will not be putting up my blinds when I leave. I just feel that this guy is sitting in his office bored and going through the lease trying to find out what memo he can come up with next to get under my skin. I feel like I am being bullied at a place that I am supposed to call home. I don't know if I am the only one he is doing this too but I do know that other people have the same square missing in their mini blinds from their cat too....did they get the memo?? I can't go on fighting with this guy. If there is anything I can do please let me know. Also if there is a legal way to break my lease I am up for that too. Thanks in advance. ~Wenelyce~

P.S. My last name is mispelled on my lease....is it valid still????
 
Wow!....thats pretty tough ......You can try finding out from your local council (county) rental grievance body (can't remember what it is called). There is a place for apartment renters to file a grievance in every council or county. You could talk to them to let them know what has been going on……They would advice to a possible remedy if any. They would talk to him if they deem your claim fair or if they feel he is crossing the line. Focus on the aspects you raised here stating he is changing your lease agreement. He has the right to do it but if you don't accept you should be left by law to move out without any penalties or bad rental record in the system since it would directly affect your style of living. Just make sure there is no clause on your contract saying he can change the policy and your lease still valid without your permission or acceptance. Some changes are allowed without your permission but those which could change your style of leaving; you have a claim to. Most leasing agreements are air tight in favor of the owner....You can try and see…..Good luck.
 
He probably wants the blinds replaced because it's an eyesore to the rest of the neighborhood. Also...if it states in your lease that you are required to have a pet deposit and you havent paid it yet...then yes, your in breach of your lease and can be evicted.
