HI, I have a question about a case im going through in Ohio. I am being charged with three Felony 3s trafficing cocaine and 2 felony 4s Marajuana. Im not worried about the two F4s. The three felony 3s is what i have questions on. The prosecutor has an infromant who has been in prison 5 years and is still going through legal matters. They have no video, pictures, marked money, and they have 3 tapes with no transaction on them. On 2 of the tapes you hear my voice and the informants voice, but not talking about anything illegal. On the third tape its the same thing, but on this tape i just let him know a price for some marajuana. But still no trasaction of a cocaine buy or convesation about it. I have a public defender and they want me to plea to two F3s. What should i do? Should I take it to trial? Do the prosecutor have enough evidence to convict? I am clueless, but i dont want to take the plea of the two F3s. I have no prior record also.

Too hard to say without seeing/hearing the evidence and knowing the details of the case.
In short- it is your choice whether or not to accept a plea deal. Just because they may not have the evidence doesn't mean that you didn't do it... so it is your choice to take the risk and go to trial.
I'm more sympathetic to people that flatly deny the charges and had no involvement... that's when it is tough to take a plea deal when the evidence is stacked against you.
If you go to trial and are convicted anyway- at least you won't be there on a bad conviction. If you want to take your chances on a technicality or lack of evidence then go for it... but if you do, you might want to upgrade from the public defender.
