Felony Aiding and Abetting Drive By Shooting.

I have a case pending , and ive pleaded non guilty to get some buy more time, and its been pushed out passed a year now. Its set for a trial on monday. The state have not given me any decent plea bargains . The best one ive had so far is Aiding and Abetting Drive by shooting against a motor vehicle not occupied or building, I have a deployment coming up next month we mobilize . I was just wondering if there is any way we can get like a deferred sentencing till i come back or something like that. It was with a bb gun.

Because you're deploying, your command can request this legal action be delayed, until you return.

It will require a letter from your commanding officer, addressed to the judge, invoking your involvement in our nation's national defense. An alternative option, would be to seek a similar letter from your Staff Judge Advocate.

That, of course, requires you to inform your chain of command about these events. If you had done that, you might not be deplorable. That decision is often left to your local command structure.

You can appear and request another continuance. You could get deployed, and a letter from a deployed commanding officer will automatically get this deferred.

I suggest you discuss your options with your attorney. I'd recommend this especially if you haven't informed your chain of command previously of your legal plight!
