So me and my manager closed the store at night. Since we had just moved to a 2week pay period, she said it'd be okay to take some items such as food and detergent with the intention to pay them back the next day (which others had done before but in a lesser scale of 1-5 items). We'd write sku's down and pay for them later. Well, were were in the end caught red handed with the items. The DM called cops and told us both to write statements down saying we were "sorry we stole", etc. While waiting i decided that she hadnt the right to tell us what to write and took my paper back, said i recanted it and threw it away. Well the cops charged me with a felony for tampering with evidence and a misdemeanor and my manager got only misd.
She got 6 months probation, they are trying to give me a year and felony charge.
What i want to know is if in fact i should be charged for felony and/or misdem. when there was no "intent to steal" but to pay back, my manager who is my "boss" told me it was okay to do so, and if ripping up my own statement which was somewhat coerced and taken by my DM (not an actual police officer) and me recanting it is actually considered a felony? Any idea as to how to fight this? I believe i should get the same as manager or less since she was in charge and told me it was okay. Please help me asap. Thank you
