:(Just recently my fiance passed quite unexpectedly, we lived together for the last two years but everything was in her name. About two years ago she purcased a car which I made payments, and both our names were on the insurance, but she filed chapter 13, in which the car was listed as one of the items. Her son is now claiming all the things she had, I still have the car but was wandering what are my rights?

You have no rights to any if her things.

You are a legal stranger to her.

You have no legal standing.

Your situation is why people get married.

Her son (and any other children, absent a husband) are her legal next of kin.

They are her heirs.

Unfortunately for you, you are nothing to her but a legal stranger.

Had she written a will, that might have altered the outcome.

Alas, she failed to do that, too.

Unfortunately, absent a will, you probably have no legal rights to anything. Her son is next of kin.
 
I know I have no rights to her things, but I was mainly refering to the things we purchased together, I never wanted to claim her things. I also wanted to know exactly how can I find out about her will?

If your name isn't on those things, they are hers. The car is one example. Legally it is hers. A microwave, flat panel, things that aren't titled you could probably just claim and keep. Others can't prove they belonged to her.

If she had a will you'd know about it.
Wouldn't she have told you about one?

Otherwise, try your recorder of deeds or county clerk.
