I have lived with my fiancee for about 3 years now, and things latey have not been going good. She ended up moving out 1 week after we signed a new lease on our apartment. We both depended on each others income to make the rent payments, as we are young and both almost done with college. I went to our apartment office and the manager said that all she has to do is sign some paper saying she is leaving the apt. and the finical responsibility is now on me to make the rent payments. I asked the management what if i just paid my half of the lease and not hers, they said we would both be filed on at the local magistrate office, even though they would know I have been making my share of the rent. Is there some way i can recoupe the extra half of the rent? The way I see it is like some form of abandonment on her part. As I am in college and dont make a whole lot of money, i depended on her part of the rent to keep a roof over our heads. I just dont see how she signed a binding contract, but all of a sudden she just has to sign a paper saying she is leaving and that clears her of all financial responsibility.

BTW state we are in is Pennsylvania and in Dauphin County

Management is not willing to get into the romantic mess between the two of you; they only wish their rent.

Have you discussed with management whether it would be alright for you to sublet the rental unit to another person?

Since you both signed the lease you could consider suing her for her share of the owed rent. Management typically will not be showing up in court to say they wrote her off this lease.

Yes, they said I could try to find a roommate which i have one lined up, but he cant move in till October.

But subletting to another person or couple is not possible; it says not subletting on the lease

I agree with Gail. I'm curious - could you sign a document stating you are leaving the apt first? I find it very strange that she has a way out that is not available to you.
