Fictitious Insurance

My husband has to go to court in a couple of days for a ticket he got for fictitious insurance, he had told a friend of his that he had to provide proof of insurance to the court and didnt have any, and his friend said dont worry about it i can help you, my husband told him no, and he and i went to geico and bought insurance, a few days later in the mail we got some fake documents from his friend, well i was dumb and left them on the counter with the other mail and the valid geico insurance, and my husband on the day he had to show proof, took the wrong one. When the clerk told my husband it was invalid, he told her he could bring the valid one, that it was a mistake, and she told him no, he had already presented the frauded one. It was a misdemeanor, and he has no prior record.

What will happen to him when he goes to court? Jail time? Probation? if he is on probation, can he move out of the state? we are planning on moving to florida at the end of the month..but we are really scared they will put him in jail, all because he has bad eyes and was in a hurry.

Any help is appreciated, he has no prior record.
 
Can he provide documented evidence Geico insurance was purchased prior to the event?

It is usually wise to see a lawyer if a misdemeanor is involved. Many will give an initial consultation to scope out how big the problem could be over the phone for no charge.
