Filing for divorce

Hi! Im planning to file for divorce. I left my husband last Nov 08, And I took my son with me. He is now 2 yrs and 6 months old. I moved in here in Missouri and currently staying with my sister. Luckily I found a job here ( Part time ). My question is can I file divorce here in Missouri?? My husband lives in Virginia. How long will the divorce take? By the way, We got married in Las Vegas 5 years ago. God bless.

You have to be in your newstate for 6 months before you can file. Also your ex can file in his state before then and he can ask for custody. Did you leave the state with his permission? If not all you can do is hope he doesn;t file in his state. Also since you moved, be prepared to provide some or all of the transportation to visits.

In order to file for divorce in Missouri, you must be a resident for 90 days. So, after you've lived there for 90 days, you can file. There is no way to predict how long the divorce will take.

If your husband files first, then you may have to return the child to Virginia.
