Generally, the IRS considers the custodial parent as the one entitled to claim the children. However, in some divorce decrees, there is a stipulation that the parents will take turns claiming the children. If there is no such stipulation in yours, then you should be able to claim the child (or children, if you have more than one.)
 
The decree takes precedence. If it is not mentioned, then the CP gets to claim.
