A couple of years ago i broke my leg and went to a Doctor for treatment. The Doctor requested me to have an MRI done and referred me to a specialist. At the time I had two insurances. When i went to the specialist I asked the girl at the front desk if they accepted my insurances and she said yes. So i filled out the paperwork and signed the financial responsibility document. about 4 months later the specialist sent me a letter stating they didnt accept my insurances and that I would need to pay the entire bill. I disputed it with them and when i spoke to the manager he said he was going to try again to submit to my insurance....i never heard back from them. Then about a month ago i received a call from a collection agency regarding this bill and I told them to stop calling me. Today i received a summons that im being sued for $2,725.00 + attorney costs. Now i know i signed that agreement but this just seems extremely unfair since i asked them up front if they accepted my insurance and they all the sudden dont accept it??

Please help i am very worried about this cause i was laid off from my job and I have a family to support and I think if i lose i will lose my house.

Thanks!!!!

You don't have a choice if you're being sued and hopefully this response isn't too late. Go to court but be very firm about what was stated and your case. You also need and should subpoena the person who gave you the answer about your insurance definitely covering what you were to have done.

Personally, I find this area of insurance to be reprehensible. You have no idea whether something is or isn't covered by insurance and left to paying afterwards with no ability to decide the value yourself or negotiate. What I would argue is that the doctors always protect themselves from malpractice ordering tests, even if it is borderline as to what you owe. In this instance, you were misled and couldn't make an appropriate choice. But if I read this case correctly... now that I'm thinking... you may need to countersue the doctor since the complaint is probably coming from an agency representing the company performing the MRI, not your doctor. Good luck.
