Fire caused by another tenant-no Detectors!

HELP!My unit caught fire last week due to another tenant's cigarette, the fire is still under investigation. I lost everything and my renters insurance just cancelled in March(i was moving end may so let it laspe stupid me). However, there were no working smoke detectors and no alerts before it was too late. My landlord also lives in the apartment underneath me. The other tenant also had a box of cigarettes filled with used smoke butts on his balcony for months that was visable. THe tenant at fault has no isurance and is unemployed. I also do not currently have an active lease as it was up in January. He is also asking me to lie and say the rent was higher then it actually is and wants me to sign a new lease backdating it to jan(which i WILL NOT do). Once the report is finished and if it shows that there were no working smoke detectors, can i go after his insurance under the liability portion for my personal things? All of my furniture was brand new and i have no clothes. Not to mention personal suffering. Thank God my dog got out in time;) I would appreciate any thoughts or suggestions!:)
 
Sue everyone in small claims court.
 
i do not have tenants insurance, however my landlord has insurance and once the investigation is complete and IF it shows there were no working detectors or that he was in some way liable i think i should be able to go after his insurance. I just need a lawyer;)
 
The landlord's insurance owes you no duty.

You have no contract with them.

You cannot sue them.
 
You need an attorney to review the fire dept's report and see if there is liability IF there was no smoke detector....

This is a LIFE LESSON...NEVER let your renter's insurance lapse.
