I was wondering if you can get fired from a criminal charge where you are ultimately not guilty. I know we have a union and I don't know what rights I have and I wanted some advice on this before I speak to them. I am not guilty of the charge. I work in a company in New Jersey and I am guessing that somebody will hear about this even though I have kept it quiet. Maybe somebody can tell me what other people have done in order to help themselves.

Per my reference -New Jersey currently has no law against terminating an employee for an arrest or a conviction. (or an arrest where trial is pending). (private sector employers)

Your only recourse would be through your union - you would need to talk to your union rep. as noted by shrinkmaster.

Your other post indicates the offense took place in New Jersey. If it took place in another state it doesn't seem likely anyone would know about it.
Anyway, if you are eventually found guilty it is very likely that a first time petty offense would be handled as an infraction, which isn't any more serious than a speeding ticket. This is very low level stuff that is mind numbing to prosecutors.
You could also attempt to negotiate a plea agreement that reduces to an infraction and avoids court altogether... Just pay some fines and be done with it. That is probably the most common outcome. No criminal record if handled as an infraction.

mightymoose, I believe you meant to say the other thread/post indicates the offense took place in Connecticut instead of saying New Jersey.
