Fired / flex time

I was recently fired for being late. We have no point system, but we have flex time. I get 40 or more hours in a week. I filed for unemployment, and after they contacted my previous employment, they just started giving verbal warnings to the others who have been late on and off for years. I was late less than some of the other people out there, but nothing was done to them prior to this. I have worked there for six months, and others have worked there for years. I feel like i am being treated unfairly, and that they are just now trying to take action on everyone else after i filed for unemployment, and they started investigating. The hr woman also refuses to give me my attendance records. I worked with my cousin, and she is friends with others who work there, and they personally have told her they just now got verbal warnings. Is this fair? Is it legal? Should i just leave it alone? Thanks

Fair is a relative term.

Is it legal?

Yes, an employer isn't required to provide you with a reason to terminate your relationship.

If you feel aggrieved, speak with a local lawyer.

Should you receive unemployment insurance payments has no bearing on anything, except receiving such payments.

All employees do not have to be treated the same as long as you are not discriminated against due to a reason prohibited by law (examples religion, gender, race.....).

In at-will employment you can be terminated at any time for any reason except a reason prohibited by law (again - religion, gender, race....) or unless you have a binding employment contract to the contrary. This was not a wrongful termination if you weren't terminated due to a reason prohibited by law or there wasn't a binding employment contract regarding when you can be terminated for being late that was not followed.

Kansas does not have a law that gives employees/former employees the statutory right to their personnel file.

Unfair is different than illegal.

PS - You applied for UI benefits. The state will decide if you qualify, not the employer. The employer can only contest.

It is by no means unusual, nor is it even remotely illegal, for an employee of several years to be cut some slack that an employee of six months is not. The law does not give one hoot whether something is fair or not; it only cares if it is legal. This is.

Nothing in either state or Federal law requires the employer to give you, your attendance records. Nor would it mean anything if they did.

Yes, I'd leave it alone. There's nothing in your post that even hints that anything illegal has transpired.
 
You need to hold for the UI decision & start looking for other employment.
