This is crazy.

My aunt was working for a lady for 15 years as her health care provider. My aunt was being paid thru an agency. The lady she worked for fired her and my aunt stop receiving a paycheck. The lady she worked for told her she was not receiving a check because someone quit at the agency and the checks were behind (by the way my aunt is 'slow'.) Even though my aunt was not being paid she continued to work for the lady (they live in the same apartment complex.) I learned that my aunt was not being paid so I called the lady she worked for who told me she knew my aunt was not being paid and it's the agencies fault. I called the agency and was told my aunt was fired on August 17th! I didn't call the agency until today, November 6th which means my aunt has been working for free for nearly 2 and a half months. Earlier today the lady my aunt works for confessed that she had been fired and there was no delay with the checks. I know we could file for unemployment but what other legal recourse is there, if any? The agency did not tell my aunt she was fired because when I called they acted as if my aunt should have found out from ex-client. What next? Please advise.

Contact the DOL as she is entitled to be paid for the hours she worked. See if there is an office in your city. http://www.dol.gov/

I agree with calilly; however, unless she is in Florida she should contact the state DOL and not the US DOL (calilly was not clear about that). The US DOL will only support the Federal minimum wage; she will do better going through the state DOL in almost all cases.

If she is in Florida, they do not have a state DOL so her best bet in that case is to file a civil suit, probably in small claims court.
