I have an employee who's job consists of a mix of customer sales and service a well a light physical duties.
She recently claimed that due to an old injury from horseback riding years earlier that she is no longer able to perform any physical work whatsoever.
Now she spends 80%+ of her day doing absolutely nothing (except taking extended breaks, talking & texting on her cell, etc). When customers are not present.
Is it legal for me to fire her or asking her to take unpaid leave to recover/heal since she is no longer able to perform the duties that her job includes?
I have no alternative work to offer her other than what she was doing for the first 8 months of employment.
She has been a part time employee (28 hours or less per week) for 9 months.
We are a small ccorp with 4 part time employees.
