My wife went to a local grocery store for grocery shopping. It was the 8th day she deliver baby girl. Our daughter was 8 days old at that time. When she was in the store my father called her that your daughter has wake up and is crying. She left the store in depression and tension without know that she has not paid.
Store called police and police charged her as second degree misdemeanor.
We went to doctor and she diagnosed my wife as she is under Postpartum depression.
We talked with grocery store manager and after seeing our long term shopping history with store and my wife's condition the store manager understood her situation and gave us letter that they are lifting up trespassing warning and also he written in the letter that my wife has not done this intentionally

This is the first every crime she has done. She has clean criminal history (Even no traffic ticket). We are in Tampa, FL and the amount of items was $70.

Can you please help me on following?

1). we have court date next month. Should we consult an attorney?
2). what could be the judgment by judge if she admits in court that she has done mistake but not knowingly.
3). Any other good advise please.

If this does make it to court, don't try the "Postpartum depression" excuse. Judges hear it all the time, anyone can find a doctor in this day and age to diagnose them as "depressed" it is an excuse and nothing more.
