Hi, so here is my pathetic story. I was caught stealing store (large one). Now when the police came they filled out a PTA talking about the incident that day being under $50. Here are my questions, as I do not have money for a lawyer ...

a. What should I plead? and will the court only go off of what's on the paper as opposed to what I admitted to the manager?

b. I really am sorry and embarrassed needless to say this won't happen again, but I want to ensure this is not on my record, I do not want this to come in my way from a better different job, as I don't want to ever be in this situation again?

c. Should I get a public defense as I do not have money, I don't want to blow this out of proportion I am hoping a qualify for a deferment or a program for first time offenders where none of this would appear on my records? Please advise my nerves are getting the best of me.

Please advise

I understand your response and definitely deserve it but, this is not something I am proud of, nor something that was going on for a period of time, again its been a rough couple of months and I feel very out of my element being pregnant and so unstable. Please other than making me feel worse than what I feel, if you have any helpful advise I would greatly appreciate it.

Yes, plead not guilty, ask for a court appointed lawyer. Do exactly as your lawyer instructs you to do. You'll get a deferred sentence, do community service, pay a small fine (maybe), time passes, you behave, this all goes away!!!!
But, stop talking to anyone, except your lawyer. Most if all, be patient. Don't be stupid, ever again. People have done worse, so don't hang your head. Be strong, for you and your baby. Also, make sure you see your physician, keep that baby healthy. Ask for help, no one needs to steal, and no one will go hungry. People help pregnant women and babies. Ask around, churches, welfare, police, they'll get you and your baby food. Now, stay string, buck up, and help fix this.

(You plead not guilty or have your Lawyer talk to DA about deal. If you have no lawyer ask for public defender)

(Ask your Lawyer if ACD or Diversion is available in your case. You should also consult an Attorney many offer this free for first visit so get as many as you can arm yourself with knowledge)

Should I get a public defense as I do not have money, I don't want to blow this out of proportion I am hoping a qualify for a deferment or a program for first time offenders where none of this would appear on my records? Please advise my nerves are getting the best of me (As instructed get some free consultatioons and if you cannot afford counsel then plead not guilty and request public defender. If you have gotten the consultations I suggested you will have the info you need to discuss your desires with this Public defender as its not likely he will spend much time with you)

You will be lucky if this is handled as a misdemeanor. If the information about your prior thefts from the store is in the police report it is possible the DA could file felony charges.
Your admission to repeated thefts in the recent past can be used toward showing your intent to steal when you went to the store on this occasion. That would be bad news for you.
If you are facing hard times you should be making use of charity resources in the community. Being pregnant or lacking the money does not make it OK to steal.
Obtain a public defender and hope for the best, but know that just because it was $30 of chicken does not mean it was a petty crime.
